CWJ cuts World Telenet telecom connections

CABLE AND Wireless Ltd. yesterday disconnected the telephone lines of World Telenet International Ltd, an Internet service provider, despite a Supreme Court order granted on August 14, staying all proceedings and actions until the Judicial Review Court had heard World Telenet's motion.

In a press release issued yesterday, Victor Lowe, chairman of World Telenet said "this most recent act of defiance has demonstrated a blatant disregard for the Jamaican court system, the government and the people of Jamaica by the British multi-national, Cable & Wireless."

Tara Leevy-Malcolm, Regulatory Affairs Manager, of Cable and Wireless had written to World Telenet on Tuesday informing the company that Cable and Wireless had received a fax copy of Mr. Jutice Lloyd Ellis's order of August 14. She said the company had taken legal advice and wished to inform that "Cable and Wireless Jamaica Limited is not a party to the action and no order issuing from the Supreme Court has been made against it." The letter stated further that the company intended to act forthwith in accordance with the notice dated August 11 which was served on World Telenet.

World Telenet disclosed that at 3.30 p.m. yesterday notice of disconnection from Cable and Wireless was served on the company in accordance with the August 10 decision of the Office of Utilities Regulation(OUR). Shortly after the company's lines were disconnected.

Deborah A. Newland, senior legal counsel of the OUR wrote Cable and Wireless on Tuesday stating that "We write to confirm our Mr. Winston Hay's discussion with your Mr. Errald Miller (on the 22nd instant) advising that the OUR must in light of the circumstances, disassociate itself from any action taken on the part of CWJ (subsequent to the Court Order) and in relation to disconnection of World Telenet's lines, until the matter is determined by the Court."

World Telenet took the OUR to court on August 14 concerning the terms and conditions by which it said Cable and Wireless could disconnect its telecommunications services. World Telenet contended then that Cable and Wireless had proceeded to act on the August 10 decision of the OUR and had served notice in accordance with the said terms and conditions.

Senior Puisne Judge Mr. Justice Lloyd Ellis granted World Telenet leave on August 14 to apply to the Judicial Review Court for an order to quash the OUR's decision made on August 10 this year specifying terms and conditions for disconnection of telecommunications services by Cable and Wireless pursuant to section 51 of the Telecommunictions act.

Leave was also granted to World Telenet to apply for an order to prohibit the issue of any other such terms and conditions under the Act. The judge granted a stay of all proceedings and actions pending the outcome of the judicial review. Pamela Benka-Coker, Q.C. and attorney-at-law Harold Brady made the application in the Supreme Court.
