The Port Authority (Regulation of Cruise Ship Premises) By-Laws, 2001
The public and the shipping community is hereby advised of the following Regulations:
IN EXERCISE of the powers conferred upon the Authority by Section 11 of the Port Authority Act, the following By-Laws are hereby made:-
1. These By-Laws may be cited as the Port Authority (Regulation of Cruise Ship Premises) By-Laws, 2001.
2. In these By-Laws - "Port Authority premises" means all cruise ship premises vested in, owned or controlled by the Port Authority; "Tourist Board" means the Tourist Board established under the Tourist Board Act.
3. - (i) No person shall operate or maintain any business on Port Authority premises unless such person is the holder of a licence issued by the Authority for the purpose.
- (ii) The Authority may in its discretion refuse to grant or renew a licence to operate any business under these By-Laws.
4. (1) The Authority may
a. give notice in writing to a licensee suspending his licence for such period as the Authority may consider necessary or desirable; or
b. revoke the licence with effect from such date as the Authority specifies in the notice.
(2) All rights and privileges enjoyed under any licence which is revoked or suspended hereunder shall cease to have effect from the date specified in the notice of revocation or suspension as the case may be, but such revocation or suspension shall not in any way affect the liability of the licensee or other person in respect of contravention of these By-Laws or breach of the terms of the licence that may have occurred prior to that revocation or suspension.
5. No person shall on any Port Authority premises engage in activities as a taxi operator or contract carriage operator unless -a. He is the holder of a valid permit issued by the Tourist Board or by such other body as may be approved by the Port Authority; and b. Such activities are carried out in accordance with the terms and conditions of the permit.
6. (1) The Authority may from time to time appoint such persons as it considers suitable to be inspectors for the purposes of these By-Laws.
(2) An inspector appointed under paragraph (1) may at all reasonable times inspect any business being conducted on the Port Authority premises to ensure that the provisions of these By-Laws are being complied with.
7. Every person entering or using the Port Authority's premises shall:-
(1) have a valid identification which is acceptable to the Authority and exhibit such ID at the request of the Authority or its agents
(2) conduct himself in an orderly manner and shall be decently attired.
8. No person shall enter or leave any Port Authority premises otherwise than through the gates, passages or openings appointed for the purpose by the Authority.
9. No person shall be on any Port Authority premises except with the permission of an authorised officer of the Authority.
10. Every person shall obey all directions issued by the Authority to regulate the routing of motor vehicles or other vehicles through the Port Authority premises.
11. No person shall, while on Port Authority premises - a. sell or distribute or expose for sale, any goods, wares, merchandise or animal;
b. make, dress or paint any article or material;
c. use any threatening or abusive language;
d. conduct himself in an unseemly or disorderly manner or in such a way as to provoke a breach of the peace;
e. insult, abuse, threaten, assault or molest any employee, manager or other person lawfully on the Port Authority premises;
f. wantonly discharge any firearm, throw or set any fireworks or throw any stone or other missile.
12. (1) Any person who contravenes these By-Laws shall be guilty of an offence and shall be liable on summary conviction in a Resident Magistrate's Court to a fine not exceeding Two Hundred Dollars or in default of payment thereof to imprisonment for a term not exceeding twelve months or to both such fine and imprisonment.
(2) The Authority may exclude from the Port Authority premises for such period as it may determine, any person who breaches these By-Laws.
