THREE FORMER employees of Yummy Bakery, Hagley Park Road, Kingston who were accused of defrauding the bakery of $500,000 have been freed in the Corporate Area Resident Magistrate's Court.
They are Carl Livingston, 41, accounts manager, Gilbert Gilzene, 42, accounts supervisor and Paulette Walters, a 37-year-old cashier.
When the three accused appeared in court yesterday, attorney-at-law Dwight Reece who represented Livingston submitted that the statements in the case disclosed no offence committed by the employees. Mr. Reece said the prosecution ought to do the "honourable thing."
Hansurd Lawson, Crown Counsel, in response to the submission, asked that the case be adjourned sine die (without a date being fixed).
Resident Magistrate Martin Gayle told Mr. Lawson that if there was no case against the three accused then no order should be made against them.
After the no order was made the RM told the accused they were free to go.
The allegations were that between December 2000 and September 2001, cheques were prepared in the names of persons who were no longer employed to the company and were subsequently encashed. It was also alleged that $140,000 collected for bread sales was not handed over to the company. The alleged irregularities were discovered during an audit last year at the company and the police were called in.
