I say it is dangerous

THE EDITOR, Sir:

MOST OF The Civil Procedure Rules of 2002, which came into effect 1st January, 2003, are progressive steps in the legal system of independent Jamaica.

However, the provision (Part 4, Rule 4.1) which says, 'Practice directions may be issued only by the Chief Justice' is frightening as some lawyers have put it. I say it is dangerous.

All lawyers with whom I have spoken think practice directions should be issued either by the Statutory Rules Committee or at least by the Chief Justice in concurrence with the President of the Court of Appeal, a judge of the Supreme Court, the Attorney-General, the Director of State Proceedings and one member of each of the several Bar Associations.
