Lawsuits and local justice
published: Wednesday | July 16, 2003

THE EDITOR, Sir:

WHY IS it that we don't see many lawyers in Jamaica taking up public cases and suing the responsible parties for damages or loss of service?

Foremost in my mind is the repeated damage to motor vehicles due to the improper surfaces and poor road maintenance. This is true in areas where the roads have not been repaired for decades or areas where the road surface is fraught with substandard repairs.

Other issues I can think of are: JPSCo. and the problem of billing errors which began years ago and which we seem to be stuck with forever; the mud lakes and damage to the surroundings; the earlier lead-poisoning cases in Red Pond, among others.

Is it that our laws do not allow for this type of suit or are our lawyers not inclined to embark on these endeavours because of the time involved and likelihood of failure?

I am. etc.,
