THE COURT of Appeal has reserved judgment in the appeal brought by Gresford Jones, 85, Kingston attorney-at-law, who is seeking to overturn a ruling of the Disciplinary Committee of the General Legal Council in February 2002 that he was guilty of professional misconduct.
Mr. Jones retired in October 2001 after 60 years in private practice.
He is seeking to set aside the Committee's order that he must pay $1.4 million by way of restitution as well as a $600,000 fine and $250,000 for legal fees.
The Disciplinary Commit-tee had a hearing last year based on a complaint made by Owen Ferron and found that Mr. Jones acted in breach of the Canons of the Legal Profession (Canons of Professional Ethics) Rules.
The complaint was in relation to the handling of Peter Ferron's estate.
He was also ordered to hand over the title and all documents relating to the estate and to place the $1.4 million in an escrow account in the name of the estate of Peter Ferron.
Mr. Jones, who was represented by Norman Wright, Q.C., has asked the court to find that the Disciplinary Committee was wrong in law in its finding because it had expressly stated that it could not say that the facts supported that the business was not carried out expeditiously.
