Shaws take Joey Issa to court
published: Tuesday | February 17, 2004

By Barbara Gayle, Staff Reporter

OPPOSITION SPOKESMAN on Finance Audley Shaw and his wife, Maureen, have taken businessman Joseph 'Joey' Issa and his company Cooloasis Limited to court to bar him from taking over a gas station in Christiana, Manchester, in which the parties share ownership.

Issa has alleged that the gas station is indebted and mismanaged.

The suit stemmed from the Shaw's $13.7 million debt to United Petroleum (Ja) Limited, Unipet, which Issa and Cooloasis had offset last year.

As part of the deal, it was agreed that the property housing the gas station, which is owned by the Shaws, would be transferred to Cool Oasis Christiana Limited, a company formed for the purpose.

The property was transferred on March 16, 2003 and Issa became a director of Cool Oasis Christiana.

Issa claims that he was surprised to learn he was named personally as a defendant in the matter, although he is a director of the company.

NO ARRANGEMENTS

He says he has no personal or contractual arrangements or agreement with the Shaws, and that arrangements are between the Shaws and the other two defendants, Cool Oasis Christiana and Cooloasis.

The Shaws claim that on January 26 this year the defendants wrote to them claiming that they bought the property and were taking it over February 1.

After they got the letter, the Shaws went and obtained an ex parte injunction from the Supreme Court barring the defendants Issa, Cool Oasis Christiana and Cooloasis from attempting to take control of the management and operations of Cool Oasis Christiana Limited.

The ex parte injunction ends Wednesday and the parties will be going to the Supreme Court on that day for a full hearing.

In affidavits filed in court, Issa claimed that the Shaws were indebted for $7.2 million as at December 2003.
