The judiciary and politics
published: Sunday | July 18, 2004

THE EDITOR, Sir:

WITH REFERENCE to my letter published on July 12, I wish to make it very clear that I did not suggest that Senator Delano Franklyn said that persons who disagree with Government policy should not hold judicial office. He said no such thing.

The point is that where a Government official publicly criticises someone for accepting public office and the basis of the criticism is that person's disagreement with an aspect of public policy, it could lead others to conclude that it is unwise to criticise Government's policy.

It is because a future Government may uphold such a view that the Bar Association's advocacy of an entrenched final appellate court becomes relevant.

In fairness to Mr. Delano Franklyn, kindly publish this clarification which is made voluntarily.

I am, etc.,

DAVID G. BATTS

72 Harbour Street, Kingston
