No curfew for 'Zekes'
published: Wednesday | November 3, 2004

Donald 'Zekes' Phipps

SENIOR RESIDENT Magistrate, Martin Gayle, yesterday denied the police an application for a curfew order, which would restrict the movement of Matthews Lane area leader, Donald 'Zekes' Phipps, whose bail was extended when he appeared in the Corporate Area Criminal Court.

"The police applied for the curfew order to restrict him to his Island Drive residence in upper St. Andrew. They want to prevent him from coming downtown (Matthews Lane)," said his attorney-at-law Churchill Neita, Q.C.

MORE THAN ONE HOME

It is alleged that Mr. Phipps, who lives in upper St. Andrew, also occupies more than one home in the Matthews Lane community, downtown Kingston.

He is scheduled to return to court on November 24. He is facing charges of illegal possession of ammunition, illegal possession of and dealing in ganja and unlawful possession of pharmaceutical items.

Mr. Phipps was arrested and charged three weeks ago and later offered bail in the sum of $1.5 million. Before offering him bail, Resident Magistrate Judith Pusey ordered that he be fingerprinted and subjected to a stop order, preventing him from leaving the island.

As part of the condition of his bail, Mr. Phipps is to report to the Central Police Station three times per week: Tuesdays, Thursdays and Saturdays. In the meantime, the police say they are still conducting investigations to determine the circumstances under which he came to be in possession of over $9 million which was taken from him when he was arrested.

Mr. Phipps' attorney has since given the police three days to return the money or face legal action.
