ATTORNEY-AT-LAW DON O. Foote, the Jamaica Labour Party's (JLP) caretaker for the Westmoreland Eastern constituency, has filed an application in the Supreme Court to strike out the motion filed by Member of Parliament Pearnel Charles, against the JLP.The application is set for hearing on Monday.
Foote claims in his affidavit which was filed as a "matter of urgency" that the issue in court is prejudicing the chances of the JLP candidate Harold Francis, from being successful in the polls in the by-election set for November 25 for the Bethel Town division of the Westmore-land Parish Council.
Foote said that Francis' opponents "have been actively publicising the disunity in the JLP." The attorney said in his affidavit that it is being said that the "disunity in the JLP is so bad that the leadership of the party is even in court fighting over the leadership of the party and, therefore, the voters in the constituency should not vote for Francis because the JLP is not a fit and proper party to form the next government."
Foote said, based on the constitution of the JLP, he had the authority to bring the application by virtue of being appointed by the Central Executive of the JLP as caretaker for the constituency in which the by-election will be held.
