MAHOE BAY Company Limited has sued the government over its alleged failure to pay for land adjacent to the Sangster International Airport which it had taken possession of in 2002. The government had taken the land and agreed to buy it in order to comply with regulations laid down by the International Aviation Authority. The land ,which belonged to Mahoe Bay ,was used for an extension of the sterile zone around the airport's runway.
Attorney-at-law Oswald James, who is representing Mahoe Bay, said yesterday that the suit was set for hearing on July 13 in the Supreme Court.
ACCEPTED OFFER
Mahoe Bay, a Canadian company of which Winston Finzi is company director, is contending that the government made an offer in writing in February 2002 to purchase the land. Mahoe Bay accepted the offer in a letter dated April 12, 2003.
In the claim form filed on March 22, Mahoe Bay said it made several demands for the government to complete the agreement but was rebuffed. Mahoe Bay is seeking specific performance of the contract for the sale and purchase of the lands.
The defendants to the suit are the Commissioner of Lands, the Minister of Transport and Works, the Airports Authority of Jamaica , MBJ Airport Ltd. and the Attorney-General.
