THE SUPREME Court has ruled that Alcan Jamaica Company had just cause in firing Derrick Gayle, an electrician who was found with one of the company's equipment in the trunk of his car on October 8, 1999.
Gayle had brought a suit seeking damage for negligence or breach of contract of employment. He also sought damage for slander, trespass, conversion or alternatively the return of the equipment found in the trunk of his car.
Wavel Dale, the corporate security administrator, found the starter in Gayle's car which was parked in the car park at Alcan Ewarton Works. Gayle, who was employed to the company in 1991, was suspended and later dismissed.
Mrs. Justice Hazel Harris after hearing evidence ruled that the company owed no duty of care to Gayle in the circumstances of the case and that his dismissal was proper.
