Rights during a traffic search

What are your rights and responsibilities when your vehicle is being searched by the police?

You can be arrested, even if you show your driver's licence, for specific offences under the Road Traffic Act such as:

Dangerous driving.

Careless driving.

Driving under the influence of alcohol.

Driving away a motor vehicle without the owner's consent.

Your vehicle can also be seized in any of the following circumstances:

Under section 24 of the Dangerous Drugs Act.

If the vehicle was involved or suspected to be involved in an offence.

For exhibit in cases in which the vehicle was involved in an offence.

The police do not have the power to seize vehicles operating without insurance coverage, but the owner or driver should be prosecuted.

Your vehicle can be seized:

If it is not registered or not licensed, or the vehicle's licence expired more than a month before.

If the vehicle is being operated in contravention of its licence.

Has a registration plate which is hidden or not easily distinguishable.

Has no registration plate on the vehicle.

If a PPV or CMC-licensed vehicle operating without a road licence or carriers licence. In this case, depending on the circumstances, the police may use his or her discretion whether or not to seize.
