A SUPREME Court Judge on Thurs-day freed a man of charges of shooting with intent and illegal possession of firearm because of doubts in the evidence given by a policeman who was the complainant.
Mr. Justice Andrew Rattray, in freeing Leon Hamilton, 33, of Duhaney Park, St. Andrew, said the policeman testified in the Gun Court that there was a running gun battle between himself and four men, including Hamilton.
The judge referred to the evidence that the four spent shells found on the premises came from the policeman's firearm. The judge said that from the evidence there was no damage by bullets to the building or to motorcars although the policemen said the four men who all had guns fired at him while he was in the building.
The policeman said he operated a wrecker company and was at the premises on Dunrobin Avenue on the night of October 12, 2004 guarding the premises because people had been breaking into the motorcars.
He said while there he saw four men including the accused going into the cars. When they were about to break into his car, he shouted "don't move" and the men fired at him. He said a running gun battle ensued and Hamilton was shot.
Hamilton testified that he and another man went to the premises. He admitted to having gone to the premises with another man on Dunrobin Avenue, St. Andrew to steal radios from the motorcars but that they were not armed. The other man was shot and killed during the incident.
