Portmore advised against toll appeal
published: Friday | August 5, 2005

GIFFORD

THE PORTMORE Citizens' Advisory Council (PCAC) is still undecided as to whether it will be appealing the ruling of the Judicial Review Court regarding the controversial Portmore toll road.

Reports surfaced yesterday that the council's legal adviser, Lord Anthony Gifford, had advised against an appeal.

It is understood that the advice was based, among other things, on the fact that the groups took a long time to file a court action.

But chairman of the PCAC, Reverend Barrington Soares, refused to divulge the nature of the advice given by the legal team.

DELIBERATING ADVICE

"We have received Lord Gifford's advice and we are deliberating and by next week Tuesday, we will make a statement," he told The Gleaner yesterday.

However, the Jamaica Labour Party is still going ahead with its legal challenge to the decision to convert the Portmore causeway into a toll road.

Dr. Andrew Wheatley, one of the claimants in the case, told The Gleaner that the JLP was "definitely" going ahead with its plans.

"Our case is a constitutional one and we are prepared to take it to the very highest level," he said.
