MONTEGO BAY businessmen Leebert Ramcharan and Donovan 'Plucky' Williams have filed several grounds of appeal asking the Court of Appeal to have their extradition orders overturned.
They are appealing against a Full Court ruling this month which refused to make an order for their release from custody.
The men are wanted in the United States to face charges of conspiracy to import cocaine and conspiracy to possess with intent to distribute cocaine.
SEEKING RELEASE ORDERS
In June last year, Senior Resident Magistrate Martin Gayle ordered that they should be extradited. They took the matter to the Supreme Court, seeking orders for their release from custody, but were unsuccessful.
Ramcharan, who was designated a Drug Kingpin by U.S. President George W. Bush, had complained that he would not get a fair trial because of the designation and his nationality.
The Full Court disagreed and Ramcharan is now asking the Court of Appeal to find that the Full Court erred in its decision.
The men are asking the Court of Appeal to find that the Full Court erred in law by holding that the Resident Magistrate could consider testimony coming from a person described as a confidential informant whose name was not given to them.
They are also challenging the Extradition Act on the ground that it is inconsistent and is in contravention with the Jamaican Constitution.
