Court strikes out special constables' MoU claim

THE SUPREME Court has struck out the claim brought by the Special Constabulary Force Association (SCFA) which was seeking declarations relating to the Public Sector Memorandum of Understanding (MoU) between the Government and the Jamaica Confederation of Trade Unions (JCTU).

The special constables were seeking various declarations one of which was that the JCTU had no authority to negotiate and make any agreement with the Government which binds the special constable association.

When the matter came before Justice Basil Reid last week Friday in chambers, attorney-at-law Symone Mayhew from the Attorney-General's Department applied to have the claim struck out. She argued that there were no reasonable grounds for bringing the claim and described it as an abuse of the process of the court.

Justice Reid, in granting the application, said that the declarations they were seeking would serve no useful purpose. The judge said that even if the application was not made, he would not have granted the declarations because they were superfluous.

The association was represented by attorney-at-law Don O. Foote.
