Public Defender files two civil suits against Attorney-General
published: Friday | January 27, 2006

THE OFFICE of the Public Defender has begun civil proceedings against the Attorney-General as co-defendant following the disappearance of two men who were last seen in the custody of the police.

The men were last seen on December 23, 2004 at a shopping plaza on Washington Boulevard in St. Andrew.

According to Public Defender, Howard Hamilton, a police officer has since been charged with the alleged disappearance of the two men.

And he said attorneys have also been instructed to file action on behalf of the relatives of the missing men.

Meanwhile, the Public Defender is also filing a case against the Attorney-General for an incident arising from the death of an infant at a hospital on June 7, 2004.

It is being alleged that the death was due to medical negligence.

According to a release from the Office of the Public Defender, a firm of attorneys has been retained to proceed with the litigation.

The Public Defender said this was done after the hospital's attorneys failed to achieve a negotiated settlement and as such denied liability on the part of the hospital.

In the meantime, the Public Defender says the Ministry of Finance and Planning has approved funding to cover the commencement of legal proceedings in the Supreme Court for both cases.
