Prisoner claiming unfair trial has appeal thrown out
published: Saturday | June 10, 2006

A PRISONER, who claimed he did not get a fair trial because of a judge's undue interventions during his trial, failed in his attempt yesterday to convince the Court of Appeal.

The court, after hearing legal arguments, dismissed the appeal and ordered that Omar Bolton, of Fishers Road, Rae Town, downtown Kingston, should serve his 30-year prison sentence for illegal possession of firearm and wounding with intent.

The Court of Appeal, comprising Mr. Justice Seymour Panton, Mr. Justice Algernon Smith and Mr. Justice Horace Marsh (acting), ruled that Bolton's appeal was without merit. The sentence is to run from June 27, 2002.

Mr. Justice Donald McIntosh convicted Bolton on March 27, 2002, in the Gun Court. He was sentenced to 15 years imprisonment for illegal possession of firearm and 30 years imprisonment for wounding with intent. The sentences are to run concurrently.
