The Director of Public Prosecutions (DPP) has ruled that no criminal charges should be laid against members of the Island Special Constabulary Force (ISCF) who were involved in the beating of a couple in downtown Kingston in May.
Margaret and Leroy Berry were allegedly beaten after members of the ISCF accused Mr. Berry of illegally operating a taxi.
Male officers allegedly beat Mrs. Berry after she tried to prevent further blows being meted out to her husband by the police. She was also pepper-sprayed in the eyes by a policewoman.
The incident sparked public outrage and Prime Minister Portia Simpson Miller ordered a probe into the incident.
Superintendent Dathan Henry, who is in charge of the Anti-Corruption Division of the Professional Standards Branch, told The Gleaner that the DPP made his ruling two days ago.
He said the police commissioner is to decide the fate of ISCF Commandant, William Malabver, who was taken off front-line duties, pending the outcome of the
investigations.
The commissioner will also decide whether the policemen and the policewoman woman breached any departmental rules in the
incident.
Mrs. Berry was subsequently slapped with seven charges by the police. These are: obstructing the police; indecent exposure; disobeying a lawful order given to her by the police; resisting arrest; assault occasioning bodily harm; two counts of assaulting the police; and disorderly conduct.
Her husband was charged with operating a public passenger vehicle without a licence, assaulting the police, and operating a vehicle without insurance coverage.
