Senior Resident Magis-trate Judith Pusey on Thursday granted an appli-cation for the sentencing of Nicole Ann Fullerton, daughter of Henry Fullerton, former head of the failed Caldon Finance Group, to be put off to March 1.

Fullerton was convicted last month of defrauding businessman Colin Karjohn of $15 million.

RM Pusey had put off sentencing until Thursday in the Corporate Area Resident Magistrate's Court.

Following applications made on that day by attorney-at-law Patrick Bailey, who represents family members of Fullerton, and her lawyer, Jacqueline Samuels-Brown, a new sentencing date was set and Fullerton's bail extended.

Mr. Bailey said some family members of Ms. Fullerton were making efforts to raise money to make restitution, so he was asking for an adjournment.

Fullerton, who was acting operations manager of the failed Caldon Merchant Bank, was found guilty of three counts of fraudulent conversion.

The Crown, represented by Senior Deputy Director of Public Prosecutions Paula Llewellyn, had led evidence that Karjohn gave Fullerton a total of $15 million on January 2, 1998 to invest in treasury bills, but the money was never returned to Karjohn.

RM Pusey extended Fullerton's bail after she convicted her on November 11 and suggested that she should consider making restitution as that could lessen the sentence.

The judge made it clear that she would go to prison if the money was not paid because of the amount involved. She pointed out that Karjohn was interested in getting back his money.

Henry Fullerton, who is charged with breaches of the Financial Institutions Act, is to return to the Corporate Area Resident Magistrate's Court on January 5.

The Director of Public Prosecutions is to decide whether he should be tried in the RM court or in the Home Circuit Court.
