Duncan's appeal put off

The appeal brought by People's National Party (PNP) candidate Dr. D.K. Duncan, seeking to set aside an order last week which stopped the recounting of ballots in the Eastern Hanover constituency, has been put off to October 16.

When the matter came for hearing in the Court of Appeal Wednesday, the judges said they did not get the time to read the documents filed by lawyers representing Jamaica Labour Party (JLP) candidate Barrington Gray. The judges disclosed that the documents were filed yesterday morning.

Duncan's appeal will be heard along with Gray's appeal challenging a ruling by Senior Puisne Judge Marva McIntosh.

The judge had turned down Gray's application for leave to go to the Judicial Review Court. Gray was seeking an order to compel Resident Magistrate George Burton to count some ballots which he had rejected. The RM had rejected the ballots because the signature of the presiding officer was absent.
